FAMILY AND MEDICAL LEAVE ACT (FMLA)
BEREAVEMENT LEAVE
Trinity School acknowledges the personal needs that may arise from the death of a loved one. Paid bereavement leave will be granted to all employees working 20 or more hours per week as follows:
In the event of the loss of an immediate family member, Trinity School provides up to five days of paid time off. Immediate family members include an employee’s spouse, child, parent, sister, brother, mother- and father-in-law, stepparent, stepchild, and stepsibling.
In the event of the loss of an extended family member, Trinity provides up to three days of paid time off. Extended family members include an employee’s aunt, uncle, grandparent, grandparent-in-law, grandchild, brother- and sister-in-law, and daughter- and son-in-law.
In the event that the deceased is an extended family member or non–blood relative who is deemed in loco parentis, the employee is entitled to the five days of paid time off that apply to the death of an immediate family member. In loco parentis is a Latin term meaning "in [the] place of a parent" or "instead of a parent" and confers legal responsibility to an individual to perform some of the functions or responsibilities of a parent.
Following either a miscarriage or stillbirth, an employee is entitled to up to three days of paid time off.
By special request, as approved by the Associate Head of School, up to one day of paid time off may be granted to attend the funeral of a close friend or coworker.
An employee who wishes to take time off due to the death of a loved one is expected to notify their immediate supervisor and/or department chair as soon as they learn of the need for bereavement leave. All requests for bereavement leave are to be submitted via Trinity's payroll system and will be reviewed by the employee’s supervisor for approval.
At the discretion of their supervisor, an employee may be approved to take additional time off beyond the bereavement leave granted in this policy and use their accrued PTO hours to be paid for this time off.
JURY DUTY LEAVE
Employees who are called to jury duty should inform their supervisor and the Human Resources representative immediately when notified, so that the school can provide coverage for the days missed. Employees will remain on full pay during their jury service for a period of up to 10 business days. This may be extended on an individual basis under unusual circumstances. Employees are encouraged to try to defer their jury duty service to the summer months if possible.
If the employee is dismissed from jury duty, it is expected that they will return to their regular work schedule the day after being dismissed from jury duty.
WITNESS DUTY LEAVE
An employee may be required by law to appear in court as a witness. The employee may be allowed to take unpaid time off for this purpose but is expected to give their supervisor reasonable advance notice of the absence and to provide evidence of the required appearance. Witness duty leave is available to all employees.
PARENTAL SCHOOL LEAVE
In accordance with the North Carolina Parental Leave Law, Trinity will grant up to 4 hours of unpaid leave per year to any employee who is a parent, guardian, or person standing in loco parentis of any school age child so that the employee may attend or otherwise be involved in activities at the child’s school, preschool, or child-care facility as defined by G.S. 110-86(3). This leave must be scheduled in advance at a mutually convenient time. Trinity reserves the right to request written verification from the school of the employee’s attendance.
OTHER LEAVE REQUIRED BY LAW
Trinity complies with any other leave required by law.
